Decisions on Travel and Relocation - Employee’s Spouse Must be Right Spouse At Right Time
Hubert relocated to Nashville in December 2001. IN 2003 he and his wife divorced where he remarried soon after and in 2005, purchased a new home in Nashville. Though his relocation had occurred three years earlier he was given an extension of the deadline for seeking reimbursement for a new house until December 2005. He was refused reimbursement because his name did not appear on any of the settlement documents related to the home purchase where apparently the new home was in his new wife’s name. The Board ruled against Hubert noting that properties held by the employee or "immediate family members" are entitled to reimbursement, Immediate family members include a spuouse only when that person is a member of the employee’s household at the time the employee reports at the new station. His new wife is excluded from this definition since she was not the wife at the time he was transferred (Hubert Collins, GSBCA 16766).
