A GSA solicitation for alarm monitoring and dispatch services required the project manager have at least five years of experience. The GSA downgraded NCLN’s proposal resulting in its exclusion from the competitive range because the project manager had only 41/2 years of experience and it did not include resumes of proposed dispatchers. NCLN protested after the award was made contending (1) the project manager’s experience was incorrectly measured from the wrong date and (2) resumes were not required since it intended to hire incumbent employees.
The GAO agreed the solicitation was “ambiguous” about measuring the required experience but concluded an apparent solicitation defect must be protested before the time proposals are due. It also ruled resumes for alternative dispatchers should have been included since there was nothing in the proposal – e.g. letters of interest or intent – to indicate the incumbent employees would accept jobs with NCLM (NCLM20, Inc. GAO, B-287692).
