DOD Allows Inclusion of TAA and Buy American Acts Into Commercial Item Subcontracts

The Department of Defense November 1 issued a final rule amending the Defense Federal Acquisition Regulation Supplement (DFARS) that removes the Trade Agreement Act and the Buy American Act from the list of laws that are inapplicable to subcontracts for commercial items.  This rule is a result of initiatives undertaken by DOD to make the acquisition process more efficient and effective and provide greater flexibility to innovate while limiting the contents of the DFARS to requirements set by law, DOD-wide policies, delegations of FAR authorities and only deviations from FAR requirements (Fed. Reg. 63330).
